NOTICE OF INTENT TO RENEW PERMIT NE0203947

for City of O’Neill Materials Recovery Facility

under consideration by the

Nebraska Department of Water, Energy, and Environment

 

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Water, Energy, and Environment (DWEE) has received an application to renew the permit of City of O’Neill Materials Recovery Facility, 87187 494th Avenue, O’Neill, NE 68763.  After review of the permit application, a preliminary determination has been made to recommend renewal of the permit.  The term of the permit shall be ten years.

 

FACILITY DESCRIPTION. The permit allows the operation of an existing materials recovery facility under Nebraska's solid waste management laws and regulations.  The permit allows for the operation of a solid waste management facility at which the transferring of garbage from the area, hauled in packer trucks and rolloff boxes, to the facility. The waste is then sorted to be transferred, as is appropriate, to licensed Municipal Solid Waste landfills, and the City of O’Neill’s Construction and Demolition landfill. The recovered recyclables are sorted and baled (plastics & cardboard) with paper placed in Gaylord Boxes, all to be hauled to recycling centers.   

 

FACILITY LOCATION. The property is located in the far northeast part of the City of O’Neill.  The legal description of the City of O’Neill Materials Recovery Facility is the NE1/4 of Section 29, Township 29 North, Range 11 West of the 6th Principal Meridian, Holt County, Nebraska. 

 

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING.  The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal.  Public comments and hearing requests shall be made to: Daniel LeMaistre, Waste Permit Section Supervisor, Nebraska Department of Water, Energy, and Environment, 245 Fallbrook Blvd, Suite 100, Lincoln, NE  68521-6731.  The DWEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of City of O’Neill Materials Recovery Facility, and public comment received. DWEE will notify the applicant and other interested persons.

 

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by June 29, 2026.

Select “Public Records Search” at the bottom of the page, then “Public Records Search” again.  A box will appear that needs the following information: for “Start Date” enter August 25, 2025, for “End Date” enter May 28, 2026, for “DEQ Facility Number” enter 64311, for “DEQ Program ID” enter NE0203947, for “DEQ Program” enter IWM.  Select “Search” and all the documents for that facility will appear.  Use the “Index of Correspondence” to select the documents related to this public notice.
