Notice of Public Rulemaking Hearing

NOTICE IS HEREBY GIVEN that the Nebraska Department of Water, Energy, and Environment (“DWEE”), will hold a public rulemaking hearing pursuant to Neb. Rev. Stat. § 84-907.  The hearing will be held on July 17, 2026 at 9:00 a.m., in Hearing Room 031 (lower level) at the DWEE offices located at 245 Fallbrook Blvd., Lincoln, Nebraska, 68521.

The purpose of the hearing is to take public comments on the adoption of Title 196 Neb. Admin. Code, Chapters 1-2, Nebraska Public Swimming Pool Standards A description of the purpose of proposed Title 196 is as follows: 

Pursuant to LB759 (2026), the purpose of this rulemaking is for DWEE to adopt minimum sanitary and safety requirements in the form of regulations for the design, construction, equipment, and operation of swimming pools. Chapter 1 of the proposed regulations includes the standards for the engineering review conducted by DWEE, which includes design, permitting, and construction of public swimming pools. Chapter 2 of the proposed regulations contains the minimum sanitary and safety requirements for the operation of public swimming pools, that shall be adopted by local governments (a county, city, or village or a local public health department), as required by LB759 (2026).

Title 196 as proposed is available at the offices of the Secretary of State, Regulations/Licensing Division, 1201 N Street, Suite 120, Lincoln, NE 68508 and on the Secretary of State website at rules.nebraska.gov. The description of the fiscal impacts of proposed Title 196 may be inspected and obtained at the Department of Water, Energy, and Environment, 245 Fallbrook Blvd., Suite 100, Lincoln, Nebraska, 68521 and on the Secretary of State website at rules.nebraska.gov. The proposed adoption of Title 196 is anticipated to result in decreased costs and decreased revenue to DWEE, increased costs and increased revenues to political subdivisions, and an indeterminable fiscal impact to the regulated public.

All interested persons are invited to attend and make oral or written comments at the public hearing.  Interested persons may also submit written comments prior to the hearing, which will be made part of the hearing record if received by DWEE on or before July 16, 2026 at 5:00pm.
