NOTICE OF PUBLIC HEARING AND PERMIT ISSUANCE

STATE OF NEBRASKA

DEPARTMENT OF WATER, ENERGY, AND ENVIRONMENT (DWEE)

 

The Nebraska Department of Water, Energy, and Environment (DWEE) proposes to reissue, with changes, a National Pollutant Discharge Elimination System (NPDES) permit to Archer Daniel Midland (ADM) Corn Processing, 3000 East 8th Street, Columbus, NE (NPDES # NE0130141; SIC 2046). Notice is also hereby given pursuant to the DWEE Title 119, Rules and Regulations Pertaining to the Issuance of Permits Under the National Pollutant Discharge Elimination System, Public Notice of Hearing, that the DWEE, NPDES and State Permits Section will be conducting a Public Hearing on June 10, 2026, beginning at 6:00 P.M. Central Time (CT) at the Columbus Community Building, third floor, 2500 14th Street, Columbus, Nebraska. The purpose of the hearing is to receive testimony and evidence regarding the proposed reissuance, with changes, of the NPDES Permit number NE0130141 in accordance to DWEE Title 119 in accordance with DWEE Title 115, Rules of Practice and Procedure. This facility manufactures products by dry corn milling, wet corn milling, and ethanol production. Non-process wastewater from Outfall 001 and Outfall 005 which combine with process wastewater from Outfall 002 discharge through Outfall 003 to the Loup River Canal, Segment LP1-21800 in the Lower Platte River Basin. The permit would be issued for a period of up to five years and would restrict pollutant discharges to comply with the requirements of Department regulations.

 

The draft permit, fact sheet, and other public information are available for review at DWEE’s Lincoln Office between 8:00 A.M. and 5:00 P.M. weekdays, excluding holidays, at 245 Fallbrook Boulevard, Suite 100, Lincoln, Nebraska. A copy of this permit and fact sheet are also available on the Department’s website at https://dwee.nebraska.gov. All interested persons may attend and testify orally or by written submission at the public hearing. Interested persons may also submit written comments by mail addressed to: NPDES and State Permits Section, 245 Fallbrook Boulevard, Suite 100, Lincoln, NE 68521 prior to the hearing, which will be entered into the hearing record if received by 5:00 P.M. CT, June 9, 2026. Please notify the DWEE at least one week in advance of the hearing if auxiliary aids or reasonable accommodations or alternate formats of materials are needed.
