Notice is given to the public, according to Chapter 10 of Title 129 - Nebraska Air Quality Regulations as amended September 28, 2022, that the Department is proposing to issue a Class II operating permit to Village of Ansley Light Plant, Facility (FID #7083) for the operation of two (2) large bore combustion engines; each diesel or dual fueled (Standard Industrial Classification code 4911) located at 909 Division Street, Ansley, Custer County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 1.90 tpy of Particulate Matter (PM), 1.75 tpy of PM ≤ 10 microns (PM10), 1.70 tpy PM ≤ 2.5 microns (PM2.5), 0.05 tpy Sulfur Dioxide, 98.00 tpy Oxides of Nitrogen, 35.53 tpy Carbon Monoxide, 6.13 tpy Volatile Organic Compounds, 0.24 tpy of Acrolein and 0.24 tpy of Acetaldehyde and 1.69 tpy Formaldehyde(largest quantity individual Hazardous Air Pollutants (HAPs), 2.44 tpy total HAPs, and 5,009.78 tpy Greenhouse Gases CO2 equivalents (CO2e).
Custer County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Custer County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no TRS emissions are expected from this project. No impact is anticipated on habitat for any rare or threatened species.
The Nebraska Department of Water, Energy, and Environment (DWEE) propose to issue a Class II operating permit with specific conditions, based on Title 129, which authorizes to limit NOx emissions to 98 tpy; limit the kWh generated to 6,465,901 kWh in any 12 consecutive month period; restrict fuel usage to diesel fuel or dual fuel; requirements from federal NESHAP rules (40 CFR 63) for Subparts A and ZZZZ; specifies testing requirements for various equipment; specifies inspection, operation, maintenance, and monitoring requirements; and specifies recordkeeping and reporting requirements.
The proposed permit and supporting materials are available for inspection by the public Wednesday, May 13th, 2026 through Thursday, June 11th, 2026 at the office of the DWEE, 245 Fallbrook Boulevard, Suite 100, Lincoln, Nebraska, and electronically at https://dwee.nebraska.gov/. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
