for City of Fremont Fossil Fuel Combustion Ash Disposal Area

under consideration by the

Nebraska Department of Water, Energy, and Environment

 

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Water, Energy, and Environment (DWEE) has received an application to renew the permit of the City of Fremont Fossil Fuel Combustion Ash Disposal Area, 2701 E. 1st Street, Fremont, Nebraska.  After review of the permit application, a preliminary determination has been made to recommend renewal of the permit.  The term of the permit shall be five years.

 

FACILITY DESCRIPTION. The permit allows the operation of an existing Fossil Fuel Combustion Ash Disposal Area under Nebraska's solid waste management laws and regulations. The fossil fuel combustion ash disposal shall dispose of fossil fuel combustion ash which, by definition, shall mean fly ash, bottom ash, slag, and flue gas emission control ash generated from utility plants or other facilities in which coal is the primary fuel source.

 

FACILITY LOCATION. The ash disposal area is located at the City of Fremont Department of Utilities (FDU) Lon D. Wright Power Plant property at 2701 E. 1st Street, Fremont, Nebraska. The legal description of the City of Fremont Fossil Fuel Combustion Ash Disposal Area is the NE ¼ of the SW ¼ of Section 19, Township 17N, Range 9E of the 6th Principal Meridian, Dodge County, Nebraska.

 

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING.  The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal.  Public comments and hearing requests shall be made to: Daniel LeMaistre, Waste Permit Section Supervisor, Nebraska Department of Water, Energy, and Environment, P.O. Box 98922, Lincoln, NE  68509-8922. The DWEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of the City of Fremont Fossil Fuel Combustion Ash Disposal Area, and public comment received. DWEE will notify the applicant and other interested persons.

 

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by June 15, 2026.
