Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Swift Beef Company (FID 24352), a slaughter and meat packaging facility to revise the allowable oxygen residual range. (Standard Industrial Classification code 2011 – Slaughter and Meat Packing Facility) located at 555 Stuhr Road, Grand Island, Hall County, Nebraska 68801. This permit modification is not expected to result in any changes to emissions.
All Counties in Nebraska currently meet the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS. There are currently no Counties classified as being in non-attainment with the State Total Reduced Sulfur (TRS) standards. It is the source’s responsibility to ensure no take of threatened or endangered species result from the proposed slaughter and meat packing facility.
The Department proposes to issue a construction permit with specific conditions, based on Title 129, which updates the allowable oxygen level range for the wastewater lagoon control system from 0.2 to 0.3 percent to a broader range of greater than 0.0 percent and less than 2.0 percent daily average. The permit also increases the allowable hydrogen sulfide (H₂S) concentration in biogas delivered to a third party facility from 2,000 ppmvd to 7,750 ppmvd. The permit retains all other existing operating, monitoring, recordkeeping, and reporting requirements. These revisions do not increase the facility's potential to emit (PTE).
The proposed permit and supporting materials are available Friday, June 12th, 2026 through Tuesday, July 14th, 2026 at the NDWEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska 68521 and electronically at https://dee.nebraska.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
