PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Tallgrass High Plains Carbon Storage, LLC (Fairmont Compressor Station) (FID 123340), a new carbon capture facility (Standard Industrial Classification code 4619) located approximately 0.33 miles west of the intersection of Highway 81 and Road F intersection, Fairmont, Fillmore county, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction at this facility will be: 1.72 tpy PM; 1.29 tpy of PM10; 0.02 tpy of PM2.5; 80.92 tpy Volatile Organic Compounds; 1.41 tpy of Acetaldehyde; 1.63 tpy total Hazardous Air Pollutants (HAP’s).

All Counties in Nebraska currently meet the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to NAAQS. There are currently no Counties classified as being in non-attainment with the State Total Reduced Sulfur (TRS) standards. It is the source’s responsibility to ensure no take of threatened or endangered species result from the proposed carbon sequestration facility.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which is to construct a new Carbon Sequestration Facility that can process up to 53.5 metric tons per hour of CO2 (along with other constituents), dehydrate and compress the CO2 gas stream, and then send to a pipeline for underground storage. This permit does not prescribe testing but does prescribe recordkeeping requirements.

The proposed permit and supporting materials are available Tuesday, May 26th, 2026 through Wednesday, June 24th, 2026 at the NDWEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, and electronically at http://dwee.nebraska.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing.  The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
